Company Announces Settlement with Ishmael Lopez and Matthew Weidner for Trademark Infringement
LONDON. (March 10, 2009) ─ Rosetta Stone Ltd., a leading worldwide provider of language-learning software, today announced that it successfully settled its trademark infringement lawsuit against two individuals, Ishmael Lopez and Matthew Weidner.
These settlements resulted from a trademark infringement lawsuit filed by Rosetta Stone in the U.S. District Court for the Central District of California. Rosetta Stone sought damages and injunctive relief for the illegal use of Rosetta Stone’s trademarks and confusingly similar variations as keywords in search engine advertising programs and in the header and text of the resulting sponsored links created by Messrs. Lopez and Weidner as well as others.
Under the terms of settlement, Messrs. Lopez and Weidner will each cease using Rosetta Stone trademarks in online paid search advertising campaigns and on their online websites and operations, and will provide Rosetta Stone with monetary compensation.

We are committed to protecting our customers from being confused by scam ads or scads, the deceptive sponsored search result links that appear at the top and along the side of webpage search results. We encourage those seeking to compete with us to develop their own brand and reputation, and not to infringe on our trademarks in an attempt to sell their products,” said Michael Wu, general counsel for Rosetta Stone.
The Lopez and Weidner enforcement actions are part of a robust and ongoing program to suppress the unlawful infringement of the Rosetta Stone name and brand in search engine advertising and elsewhere online.
